What Is a Partition Lawsuit?
A partition action arises when two or more people (or entities) jointly own a piece of real property and can’t decide what to do with it. For example, if a property owner dies and leaves the property to his or her children, and the children can’t agree on what to do with the property, one of the children might file a partition lawsuit. Once one of the property owners has brought a partition action, the court will decide what to do with the property, unless the owners can reach an agreement on their own outside of court. Even if the owners ultimately resolve the dispute without the court’s help, a real estate lawyer will be needed to prepare a settlement agreement and any other necessary paperwork.
What Are the Potential Results of a Partition Lawsuit?
In most cases, the court overseeing a partition action will order that the property be sold, and that the proceeds of the sale be distributed among the joint owners in accordance with their respective ownership interests. Technically, the court can order that the property in question be physically divided, with each portion going to one of the joint owners. However, this is generally feasible only if the property is a vacant lot that hasn’t been built upon. Because many properties include structures (whether they be houses or commercial buildings), it’s rare for a court to order this type of relief.
