What to Expect During Probate

  • Establish that the decedent’s will (if there is one) is valid
  • Arrange for any outstanding taxes and debts to be paid
  • Distribute any remaining estate property among the decedent’s beneficiaries

The probate timeline will also vary from case to case, and it will depend in large part on whether we use summary probate or formal probate. If either the estate is less than $75,000 (not including exempt assets) or the decedent has been dead for more than two years, our estate lawyers will likely be able to use summary probate, a streamlined approach that often takes just one to two months. But if the estate is at least $75,000 (not including exempt assets) and the decedent has been dead for less than two years, then our probate lawyers will likely have to use formal probate, which usually takes at least six months.
